Terms of Service

Article 1 (Application)

These Terms set out the conditions for using the Listory iOS application (the "Service") provided by Hironari Takahashi ("we," "us," or "our"). By using the Service, users are deemed to have agreed to these Terms.

Article 2 (Accounts)

  1. An account must be registered to use the Service.
  2. Persons under 13 years of age may not use the Service.
  3. Please provide accurate registration information.
  4. Users are responsible for managing their accounts. Actions taken through an account will be treated as actions of the user of that account.
  5. A user may not create multiple accounts for an improper purpose.

Article 3 (Prohibited Conduct)

The following conduct is prohibited when using the Service.

  1. Conduct that violates laws, regulations, or public order and morals
  2. Conduct related to or encouraging criminal activity
  3. Conduct that infringes another person's copyrights, trademarks, portrait rights, privacy, reputation, or other rights or interests (including the unauthorized posting of songs, images, or audio for which the user does not hold the necessary rights)
  4. Defamation, threats, harassment, discriminatory expression, or bullying directed at others
  5. Posting obscene, excessively violent, or self-harm-encouraging content
  6. Impersonating others or spreading false information
  7. Spam, unrelated advertising or solicitation, or repeated posting of identical or similar content
  8. Interfering with operation of the Service, unauthorized access, or exploitation of vulnerabilities
  9. Large-scale automated access or collection of information (scraping)
  10. Modification or reverse engineering of the Service, or creation of unofficial clients
  11. Any other conduct that we determine to be inappropriate

Article 4 (User Posts)

  1. Rights in posted content belong to the user who posted it.
  2. Users grant us, free of charge, permission to use their posted content (including reproduction, display, transmission, and modification) to the extent necessary to provide, display, and improve the Service (including investigating problems and testing features).
  3. Users represent and warrant that they hold the rights necessary for the content they post and that the content does not infringe the rights of third parties.
  4. We may hide or delete content that violates or may violate these Terms without prior notice.

Article 5 (Reporting and Blocking)

  1. Users may report inappropriate content or users through features in the Service. Users may also block a particular user to limit contact.
  2. We review reports and, when we determine it necessary, may hide or delete content, suspend the relevant user, delete the relevant account, or take other measures.
  3. Repeatedly submitting false or abusive reports is prohibited.

Article 6 (Paid Listory+ Plan)

  1. The Service offers Listory+, an automatically renewing monthly and annual subscription. The price and term shown on the purchase screen (App Store) apply.
  2. Unless canceled at least 24 hours before the end of the subscription period, the subscription renews automatically and the payment method linked to the Apple ID is charged.
  3. You can cancel from iOS "Settings" → Apple ID → "Subscriptions" or from "Manage Subscription" in the App. Deleting the App does not cancel the subscription.
  4. Payments and refunds are governed by Apple's policies. We cannot issue refunds directly.
  5. We may change or add benefits. If we make a material change that is disadvantageous to users, we will provide advance notice in the App.

Article 7 (Intellectual Property Rights)

Intellectual property rights in the programs, designs, logos, text, and other materials included in the Service belong to us or their lawful rights holders. Song information, artwork, stickers, and similar content displayed by the Service are obtained from the services that provide them, and the rights belong to their respective rights holders.

Article 8 (Suspension of Use and Account Deletion)

  1. If a user violates these Terms, or if we determine that a violation may have occurred, we may delete content, restrict features, suspend use, or delete the account without prior notice.
  2. Users may delete their accounts at any time from the settings in the App.
  3. No subscription fee will be refunded for any unused period after account deletion.

Article 9 (Changes, Interruptions, and Termination of the Service)

We may change the content of the Service or interrupt or terminate its provision. The Service may be temporarily suspended without notice due to system maintenance, failure, or other unavoidable reasons.

Article 10 (Disclaimer)

  1. The Service is provided as is. We do not warrant that the Service will be suitable for a user's particular purpose, provide the expected functionality or usefulness, or be free from interruptions or defects.
  2. We are not responsible for disputes arising from interactions between users. However, if we receive a report, we will respond in accordance with Article 5.
  3. Except in cases of our willful misconduct or gross negligence, our liability is limited to direct and ordinary damages.

Article 11 (Changes to These Terms)

We may change these Terms. If we make a material change, we will provide advance notice in the App or on this page. If a user uses the Service after the change, the user is deemed to have agreed to the revised Terms.

Article 12 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any dispute concerning the Service.
